Atif Burki is commercial lawyer with 12 years of experience in different facets of law, including taxation, construction, contractual, constitutional, civil, companies, banking, environmental and labor/service matters. Having extensive experience in dispute resolution. He regularly appears at District Courts, High Courts, and various Tribunals across Pakistan. He is on the panel of various Departments of Federal Government and Provincial Government such as FBR, NHA, PTCL, CDA, KPRA, PHA, FATA Secretariat, Mineral Development Department (KPK) and Political Administration of Khyber Agency.
Taxation: Atif Burki represents the Federal Board of Revenue (FBR) and Khyber Pakhtunkhwa Revenue Authority (KPRA) in litigation at the High Courts of Islamabad and Peshawar, focusing on issues under various tax laws including taxpayer assessments, audits, advance tax, recoveries, international taxation, and interpretation of Double Taxation Treaties. He also provides legal opinions to private clients, FBR offices, and KPRA.
Construction: He advise clients on bidding documents, construction contracts, contract management, dispute resolution, and arbitration, with experience in major projects like the New Islamabad International Airport using FIDIC contracts. He address issues such as time extensions, employer-induced delays, access road matters, and cost escalations, representing clients before Dispute Resolution Boards and in Arbitrations. As an Advocate on the National Highways Authority panel, he defend the Authority in court cases involving bank guarantees, mobilization advances, contractor delays, and contract terminations, and advise on liquidated damages and negotiations for amicable settlements.
Labour Laws: He provide advice on employee benefits, compensation, employment contracts, and collective bargaining agreements and represent clients before labour forums, appellate tribunals, and High Courts in matters related to labour disputes and grievances.
Banking Laws: Atif Burki advise banking sector clients on laws, regulations, and State Bank of Pakistan Manuals, and represent them in banking courts concerning defaults on finance facilities and mortgages and handle cases under the Financial Institutions (Recovery of Finances) Ordinance.
Constitution: He represents clients in High Courts challenging the constitutionality of various statutes. These include, but not limited to, constitutional petitions filed before High Courts to declare s.8 of the Finance Act 2022 ultra vires of the Constitution of Pakistan; constitutional petitions with respect to challenge to section 7E of the Income Tax Ordinance 2001; challenge as to vires of Standard Operating Procedures adopted by a government department; illegality of Statutory Regulatory Orders, etc. He also assists Attorney General and Additional Attorney General in legal research, drafting pleadings, and court preparation for matters involving several government departments.
Civil: He represent clients in civil suits and petitions on issues such as contract laws, lease & licensing laws, government acquisitions and compensations, rights in land, ownership disputes, leasehold rights etc. He also handle inheritance disputes under Muslim Personal Laws and negotiate family disputes regarding maintenance rights for widows and minors.
Intellectual Property: He advise on patent services, including patentability searches, validity opinions, and infringement investigations and guide clients through trademark adoption and protection processes, from clearance searches to registration at the Trademarks Registry.
